Terms and conditions



1.1 When the following words with capital letters are used in these Terms, this is what they will mean:

(a) Area: Jesmond, Newcastle upon Tyne or such other geographical area as is specified on our Website from time to time
(b) Event Outside Our Control: is defined in clause 4.1;
(c) Meal: the burgers (and other items including beverages) that We are selling to you as set out in the Order;
(d) Order: your online order for a Meal;
(e) Terms: the terms and conditions set out here; and
(f) We/Our/Us: Jam Jar, trading as JAR LEISURE LTD, a company incorporated in England and Wales with registered number [08401635] whose registered office is at [47 ST GEORGES TERRACE, JESMOND, NEWCASTLE UPON TYNE, NE2 2SX]].

1.2 When we use the words "writing" or "written" in these Terms, this will include e-mail unless We say otherwise.


2.1 These are the terms and conditions on which we supply any of meal (the "Meals") listed on our site to you.

2.2 By placing an order for a meal through this website you are confirming you are at least 18 years old and, in the event of electronic payment, acting with express consent of the credit card holder.

2.3 Please ensure that you read these Terms carefully, and check that the details on the Order and in these Terms are complete and accurate, before you confirm your offer to purchase any products from us.

2.4 Our acceptance of the Order will take place as described in clause 2.5.

2.5 These Terms will become binding on you and Us when the Order confirmed screen appears , at which point a contract will come into existence between you and Us.

2.6 If any of these Terms conflict with any term of the Order, the Order will take priority.

2.7 This website is solely for the promotion of Meals and products within the areas to which we deliver. Unfortunately, We do not deliver to addresses outside the Area, you are however more than welcome to phone your nearest store directly and collect the order from there.


3.1 We may revise these Terms from time to time in the following circumstances:
(a) changes in how We accept payment from you; and
(b) Changes in relevant laws and regulatory requirements.


4.1 We endeavour to delivery all meals to our customers on time and in full. As it happens from time to time factors outside our control such as fire, snow, ice or broken traffic lights may delay our drivers by a greater time than we estimated when you placed the order. We will though contact you if we become aware of any significant delay to your order.

4.2 Delivery of an Order shall be completed when We deliver Your Meal to the address you gave Us or you collect it from Us and in each case you have made full payment.

4.3 For the safety and security of our delivery team, orders delivered to tower blocks of flats or hotels will be delivered to the main reception only.

4.4 To purchase any alcoholic products you must be over 18 years old. Our stores may only operate and provide alcohol within the terms and hours permitted under that stores specific alcohol license.

4.5 When delivering an order containing alcohol our delivery team will operate a strict ‘Challenge 25’ policy with regards the individual receiving the order. Please have photographic identification of either a valid passport or driving license when taking receipt of your order. If you fail to provide appropriate I.D. upon request any alcohol will be retained, and, if a pre-payment was made, a full re-fund will be issued to you within 48 hours.

4.6 Cancellation of an order can be made not less that 15 minutes prior to the delivery arriving with you the customer.

4.7 We reserve the right to decline any order, customer or registration and the right to terminate your right to link to our site, remove you as a user and prevent any further use of our site if you breach any obligations under these terms and conditions.


At Jam Jar we are dedicated to providing our customers with the most excellent quality food possible at any given times. However, in a busy working environment, such as ours, cross contamination between food products is possible and despite our best efforts may happen from time to time. If you have any allergies or specific dietary requirements (particularly to an item currently on our menu) please make explicit note of them on your order or and to further reduce any risks please phone the store directly and speak to a member of staff explaining the nature of your requirements.


We do not accept returns for any Meal delivered. We endevour to ensure that our orders leave our kitchen to our highest standards. Cancellations can be requested as described in clause 4.6.


7.1 The price of the Meal will be set out in Our price list in force at the time you make your Order and includes the delivery charge, unless stated otherwise. From time to time it is possible there will be errors on the website leading to the incorrect price being shown. If this is the case the store should call to inform you of the error.

7.2 These prices include VAT.

7.3 Payment can be made for you meal, via all major credit and debit cards on our website. Cash payments are not accepted by our riders upon delivery.

7.4 Payments made online by credit card are processed via Barclays secure online gateway. Upon clicking the ‘Pay by card’ option you will then move onto a page hosted by Barclays ensuring your credit card details are always kept safe. Jam Jar never records your credit card details.


8.1 To the extent permitted by the laws of England and Wales, Jar Leisure Ltd (trading as Jam Jar) offers the content on our website on an ‘as available’ and ‘as is’ basis and we make no warranty of any kind, express or otherwise, regarding the content or availability of our site. Whilst we do make any not warranty as to content and availability we will always try to maintain our website so that it will be timely and error-free, that defects will be corrected, and that our site or server that makes it available are free of viruses or other harmful components.

8.2 Subject to the above, neither Jam Jar nor any of its directors, officers, agents or employees shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use our site. Our liability for losses you incur as a result of Jam Jar, or anyone acting on its behalf, breaching this contract, including deliberate breaches, is strictly limited to the purchase price of the meals you order. This does not include or limit in any way our or our agents or employees’ liability for any matter which it would be illegal for us to exclude, or attempt to exclude, our liability.

9.3 If you wish to contact Us in writing, or if any clause in these Terms requires you to give Us notice in writing (for example, to cancel the contract), you can send this to Us by e-mail, by hand, or by pre-paid post to Jam Jar at 88 Osborne Road, Newcastle Upon Tyne. Tyne & Wear. NE2 2AP or info@jamjarjesmond.co.uk. We will confirm receipt of this by contacting you in writing. If We have to contact you or give you notice in writing, We will do so by e-mail, by hand, or by pre-paid post to the address you provide to Us in the Order.


10.1 We will use the personal information you provide to Us to:
(a) provide the Meal;
(b) process your payment for such Meal; and
(c) inform you about similar products or services that We provide, but you may stop receiving these at any time by contacting Us.

10.2 We will not give your personal data to any third party.


11.1 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

11.2 If We fail to insist that you perform any of your obligations under these Terms, or if We do not enforce Our rights against you, or if We delay in doing so, that will not mean that We have waived Our rights against you and will not mean that you do not have to comply with those obligations. If We do waive a default by you, We will only do so in writing, and that will not mean that We will automatically waive any later default by you.

11.3 Jam Jar has the right to revise and amend these terms and conditions from time to time. Any changes we make to these terms and conditions will be posted on this page. You will be subject to the policies and terms and conditions in force at the time that you order a meal from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority.

11.4 These Terms are governed by English law. You and We both agree to submit to the non-exclusive jurisdiction of the English courts.
